We are a professional and experienced Customer Experience Measurement Agency, with core skills in Brand Auditing, Mystery Shopping & Training, delivering improvements in profit, culture & compliance for our clients.

We deliver improved customer loyalty and operational execution in our Client’s business performance through our mix of industry expertise, advanced data and insights, real cultural engagement from our people and tailor-made programmes.

The purpose of this website is to aid the legitimate interests between Retail Active and existing and/or perspective customers and/or self-employed agents (Shoppers) who conduct mystery shopping and audits on our behalf.

2. What is this Privacy Notice for?

We take our obligations under applicable privacy laws seriously, including those under the General Data Protection Regulation (GDPR) and Data Protection Act 2018. This Privacy Notice gives you information about how we will use Personal Data.

When we refer to ‘Personal Data’ in this Privacy Notice it means any information that relates to you from which you can be identified.  We are a Data Controller of Personal Data collected through our websites.

3. What Personal Data do we collect?

The Retail Active website (https://www.retailactive.com/) has the ability to collect Personal Data from the places described below.

We provide a ‘Contact Us’ facility available on the ‘Get In Touch’ webpage for any enquiry a user may have, including the reporting of suspected fraudulent activity.

The following Personal Data must be provided when using the ‘Contact Us’ facility;

  • Name
  • Email address

The user is also required to enter a message (free text), describing the purpose for which he or she is contacting us. The message may contain Personal Data, depending on the information provided by the user.

The following Personal Data is optional;

  • Mobile number
  • Company Name

We also provide the communication facility for any current or prospective Shopper to contact Retail Active that may experience technical difficulties when using the website to sign up to become a Shopper.

The following Personal Data must be provided by Shoppers when contacting us regarding technical difficulties.;

  • Name
  • Email address

The user is also required to enter a message (free text), describing the nature of the technical difficulties. The message may contain Personal Data, depending on the information provided by the user.

The following Personal Data is optional;

  • Mobile number
  • Company Name

Any communication from these methods, inputted into https://www.retailactive.com/, is directed to an email address (info@retailactive.com) that transmits the message to appointed Retail Active personnel.

No Personal Data or comments are stored on the Retail Active website.

Prospective Shoppers who wish to sign up to become a Shopper using https://www.retailactive.com/join-us/ are directed to https://retailactiveshopper.co.uk/shopperSignup.asp that is operated by ShopMetrics Ltd (https://www.shopmetrics.com/), our third party vendor, where we ask prospective Shoppers to provide the following information;

We also passively collect (i.e., without the user actively providing the information) Personal Data about a user as the user accesses and navigates through this website using various technologies and means, such as navigational data collection and cookies, as detailed below.

Your use of the website and your provision of Personal Data to us in the process is purely voluntary on your part. Subject to your discretion, you can, at any point, stop using the website. However, if and to the extent you want to enter into or perform a contract with us or through the website, or wish to contact us, your provision of Personal Data is necessary for us to enter into such contract or provide you with a response to your enquiry.

  • To provide a communication portal to Retail Active allowing any visitor to the website to submit enquiries to us, including the reporting of suspected fraudulent activity, and to allow us to respond back to such enquiries.
  • For any current or prospective Shopper to contact Retail Active who may experience technical difficulties when using the website to sign up to become a Shopper, and to allow us to respond back to such enquiries.
  • For users to enrol to become a Shopper, and for us to review and onboard such prospective Shoppers.
  • To manage and administer the website.

We process your Personal Data on different legal bases, as follows:

Our Legitimate Interest – If you are visiting our website and/or provide Personal Data to us through this website, you are most likely an employee, a prospective or current client, or a prospective or current Shopper.

In that respect, we process your Personal Data:

  • To facilitate simple communication between you (the visitor the website) and Retail Active
  • To facilitate the enrolment of any prospective Shopper that may wish to represent us (Retail Active)
  • To detect and prevent fraud
  • For the security and safety of the website, our technology connected to the website, and the users of the website
  • To manage and administer the website, including analysing web traffic and utilizing web analytics solutions

Our Legal Obligations – We may need to process your Personal Data to comply with relevant laws, regulatory requirements and to respond to lawful requests, court orders and legal process.

6. Disclosure of Your Personal Data

We may share your Personal Data in the following situations:

  • Our use of third-party suppliers and service providers, including:
    • We use a third-party I.T. supplier (TSOhost https://www.tsohost.com/data-centre-and-network) as a cloud hosting provider. No Personal Data is stored on the Retail Active website (https://www.retailactive.com/).
  • Personal Data provided and inputted by prospective and current Shoppers is directed to a third-party provider (Shopmetrics https://www.shopmetrics.com/).
  • If instructed by enforcement organisations (e.g. Police, courts, law enforcement agencies)
  • To the extent necessary to establish, exercise or defend legal rights or claims, or for the purposes of investigating actual or suspected unlawful activity.
  • To companies affiliated with Retail Active, such as its parent company, in connection with the management and administration of the business.

7. Business to Business Marketing

As a part of our marketing practice, we make unsolicited contact with companies, including individual employees of such company, by telephone or email to inform them of our services that could result in a mutual commercial interest. We obtain the contact details for such companies and its employees from public information including company websites, business and social media, sector news and industry conferences. We also may have obtained such contact details directly from you or your company if you or your company have previously contacted us using a corporate phone number or corporate email address. Any Personal Data collected and processed for our business to business marketing practice as detailed herein is done so pursuant to our Legitimate Interest to market our services to you.

8. Security

We take the security of all Personal Data very seriously and we use appropriate measures to protect all Personal Data collected in a secure, controlled environment consistent with GDPR and UK Data Protection Act 2018. We ensure that we have appropriate Data Processing Agreements in place with any third parties who will access or otherwise process your Personal Data on our behalf.

In certain circumstances, your Personal Data may be transferred outside of the European Economic Area (EEA) to comply with legal or contractual requirements, or in connection with our use of IT vendors or services providers located outside the EEA. If your Personal Data is sent outside the EEA, we have in place safeguards, including EU Model Contracts for the Transfer of Personal Data to Third Countries, to ensure the security of your Personal Data.
